With sweeping changes in credit law, consumers find themselves scrambling for solutions. Should I get credit counseling? Should I declare bankruptcy? Can I declare bankruptcy? Where do I start? These are pressing questions facing many people today. In this brief article I will outline some steps to consider when developing your debt consolidation plan.

Debt consolidation is simply a step towards bringing your debt into a manageable state. The process as a whole may involve debt settlement, debt restructuring or more drastic measures like declaring bankruptcy. If you have concluded that the latter (bankruptcy) is your best course of action there is one important change in the law that you must comply with. New bankruptcy law requires that consumers seek ‘consumer counseling’ assistance prior to being eligible for bankruptcy. If the stress is mounting and financial doom looming I suggest you begin the counseling process right away.

Credit Counseling is a relatively painless process of evaluation and consultation. You will normally be able to reduce your debt payments by around 50% by allowing the credit counseling organization to represent you. This process will have an adverse effect on your credit but at this point it may not matter to you. If after you make an effort to utilize credit counseling and it proves to-little-to-late, bankruptcy becomes an available option.

As a credit specialist my recommendation would be to think long and hard before considering either credit counseling or bankruptcy. You can remedy most situations yourself with the right plan. Obtaining the right debt settlement software could help turn things around in as little as a few hours. A challenge I often see is caused by the chaotic state of mind that usually surrounds financial hardship. This dynamic may adversely affect your consistency. You know yourself. If you can dig in and fight for your financial solvency then you will save thousands of dollars and potentially save your credit rating. If you don’t have time, or the do-it-yourself road just isn’t for you, credit counseling or bankruptcy may be imminent…and that is ok. Hard times happen to good people.

In my opinion, the most important thing you can do to get ahead of this situation is take action. It is easy to avoid issues in hopes that they will just go away…it is human nature to do so. After all, who wants to speak to a rude collection agent or attorney after all? Unfortunately you will only be compounding the problems if you avoid them. Be brave. Either get a system for managing a debt consolidation campaign or contact a credit counselor for advice. Just because you talk to a counselor does not mean you are obligated in any way to use the service. As a matter of fact, I recommend taking advantage of their free expertise. Concentrate on the solutions and they will begin to manifest themselves in the form of growing security and peace-of-mind in your life.

The Easy Way To Build A Good Credit Score

You must state the facts and explain why you have disputed the information. You must request that the information should be corrected or deleted.

You can also enclose a copy of your report along with the items in question. You can send your letter through a certified mail and you should keep the return receipt that is requested so you can document what the consumer reporting company has received from you, and when it was sent. It is important that you keep the copies of your dispute letter with the enclosures.

The consumer reporting companies should investigate the items in the question, this usually takes no more than 30 days unless the company considers your dispute frivolous. Prepare to Make Long-term Care Choices

Several months ago, I was coming out of a gas station when a woman stopped me and asked me what I did for a living. On the back of our van is our web address. On the side wing windows is “Free Senior Home Placement.” I explained to her that I am a Long Term Care Consultant. She breathed a sigh of relief. “Great I need you!”

She went on to explain that her mother had fallen and was in the hospital. Her hip had been broken, and she was going to be discharged from the hospital in two days. She was going to require 24-hour care. To complicate matters her mother had been caring for her father who was unable to walk, or feed himself. Suddenly they found themselves in the middle of a crisis.

Families never expect to be in a situation like this. But situations like this happen all of the time. Here is a list of things families should do to be prepared for a crisis.

While your parents are still mentally cognizant discuss with them the kind of long-term options they would prefer. Discuss, nursing homes, assisted living facilities, adult family homes, boarding homes, or in-home care.

Prepare a notebook that includes documentation, such as physicians phone numbers, attorney’s phone numbers, bank account information, ministers phone number, power of attorney documents, and their living will.

Educate yourself on the kinds of facilities that are available in your area, or where your parents live.

Contact your local department of social and health services, find out what resources that they have available if you should need financial support. Fill out the paperwork ahead of time, leaving the date and other time sensitive information blank.

Discuss some of these issues with your siblings before hand, so you do not have to deal with family dynamics in a crisis.

Visit facilities and discuss prices so you know what your parents are able to afford. (Note that when the time comes circumstances may be that they cannot live in the kind of facility that they would prefer, especially if they require heavier care than they had anticipated.)

Being unprepared when a crisis hits will leave you scrambling. If you have done a portion of the legwork before hand you can face the crisis before you with a measure of confidence. ~Dutchy
